1. Agreement to These Terms

These Terms of Use (“Terms”) form a binding agreement between you and Awesome Korean (“we”, “us”) governing your use of the Podo Speak mobile application and any related services (together, “the App”).

By downloading, installing or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.


2. The Service

Podo Speak is a Korean speaking-practice app. It plays a Korean sentence and asks you to say it aloud. While it is your turn to speak, the App records your microphone input, transcribes it using an automated speech-recognition service, and scores how closely your speech matched the target sentence. See the Privacy Policy for how that audio is handled. It also tracks practice time, streaks and progress, and can send you a daily reminder.

The App requires microphone permission to function and an internet connection for speech evaluation and content loading.


3. Eligibility

You must be at least 13 years old to use the App (16 in the European Economic Area and the United Kingdom, 14 in the Republic of Korea, or the minimum age of digital consent in your jurisdiction, whichever is higher). If you are a minor under the age of majority where you live, you may use the App only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.


4. Your Account

  • The App creates an anonymous account automatically on first launch so your progress can be saved. No email address is required.
  • You may optionally link your account to Apple or Google sign-in so your progress survives reinstalling the App or changing devices. We strongly recommend doing so — if you use the App anonymously and delete it or lose your device, your progress cannot be recovered.
  • You are responsible for maintaining the security of the Apple or Google account you use to sign in, and for all activity that occurs under your Podo Speak account.
  • You may delete your account at any time in Settings → Delete account. Deletion is permanent; your learning history, statistics and streaks cannot be restored afterwards.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent this restriction is prohibited by applicable law
  • Tamper with, circumvent, or attempt to bypass the App’s security measures, device-integrity checks, usage limits, or subscription gating
  • Access the App’s backend services through automated means, scripts, bots, modified clients, or any method other than the official App
  • Submit audio containing content that is unlawful, abusive, harassing, defamatory, or that infringes anyone’s rights
  • Overload, disrupt, or interfere with the App’s servers or with other users’ use of the App
  • Copy, redistribute, resell, sublicense, publicly perform, or create derivative works from the App’s learning content or audio
  • Share, sell, or transfer your subscription entitlement to another person

We may suspend or terminate your access if you violate these rules.


6. Subscriptions and Payment

6.1 Free and paid tiers

  • Free: you may complete one learning session per day. The onboarding session does not count against this limit. A session counts only when you complete it, so leaving a session early does not consume your free session for the day.
  • Unlimited (paid): unlimited learning sessions, offered as an auto-renewing subscription on a monthly or annual plan.

We may change the features included in each tier, or the limits of the free tier, on reasonable notice. Changes will not reduce what you already paid for during a term you have already been billed for.

6.2 Billing (auto-renewing subscription)

  • Payment is charged to your Apple App Store or Google Play account at confirmation of purchase. We do not receive or store your payment card details.
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of the plan you selected.
  • Current prices, plan durations and any promotional terms are shown in the App on the subscription screen before you purchase. Prices may vary by country and are subject to change; any price change will be disclosed to you and, where required, will require your consent before taking effect.

6.3 Managing and cancelling

You can manage or cancel your subscription in your store account settings:

Cancelling stops future renewals. You retain access to paid features until the end of the current billing period. Deleting your Podo Speak account does not cancel your subscription — you must cancel through the store.

6.4 Refunds

All purchases are processed by Apple or Google, and refunds are governed by their policies. We cannot issue refunds directly. Request a refund through Apple (https://reportaproblem.apple.com) or Google Play. Where mandatory consumer protection law in your country grants you a statutory right of withdrawal or refund, that right applies and is not limited by this section.

6.5 Restoring purchases

If you reinstall the App or change devices, use Restore purchases on the subscription screen. Your subscription is tied to your Podo Speak account and to the store account used for the original purchase.


7. Your Content and Voice Input

  • You retain all rights to the audio you record through the App.
  • You grant us a limited, worldwide, non-exclusive, royalty-free license to process your recorded audio solely to transcribe it and score your pronunciation, and to process the resulting transcript to operate and improve the App’s scoring accuracy. This license exists only for as long as necessary to provide those functions.
  • We do not store your voice recordings on our servers and do not use your voice to create voice profiles or biometric identifiers. See the Privacy Policy for details.

8. Intellectual Property

The App, including its software, design, learning content, sentences, translations, synthesized audio, trademarks and logos, is owned by Awesome Korean or its licensors and is protected by copyright, trademark and other laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial language learning. All rights not expressly granted are reserved. You may not use the App’s content to train machine learning models or to build a competing product.


9. Third-Party Services

The App relies on third-party services including Google Firebase (authentication, database, storage, serverless functions, analytics, crash reporting, device integrity), a speech-transcription provider, a subscription-management provider, and Apple and Google (sign-in and payments). Our current providers are listed in the Privacy Policy, and we may change them as the service evolves. Your use of the App is also subject to those providers’ terms. We are not responsible for third-party services’ availability, performance, or acts and omissions.

Podo Speak is an independent product and is not sponsored by, endorsed by, or affiliated with Apple Inc., Google LLC, or any other third party whose services it uses.


10. Educational Disclaimer and Availability

  • The App is an educational tool. We make no guarantee that using it will produce any particular level of Korean proficiency, test result, or learning outcome.
  • Speech recognition is automated and imperfect. Scores may occasionally mark correct speech as incorrect, or accept imperfect speech, particularly in noisy environments, with strong accents, or with unusual microphone hardware. Scores are practice feedback, not an authoritative assessment of your ability.
  • We aim to keep the App available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the App, including features and content, at any time. If we discontinue the App entirely while you hold a paid subscription, we will provide notice and a pro-rated refund where required by law.

11. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. Nothing in these Terms limits any non-waivable statutory consumer rights you have.


12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • We are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, data, goodwill, or learning progress, arising out of or relating to your use of or inability to use the App.
  • Our total aggregate liability arising out of or relating to these Terms or the App is limited to the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) USD 50.

These limitations do not apply to liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.


13. Indemnity

You agree to indemnify and hold harmless Awesome Korean and its officers, employees and agents from any claims, damages, liabilities and expenses (including reasonable legal fees) arising out of your violation of these Terms or your misuse of the App, except to the extent caused by us.


14. Termination

You may stop using the App at any time and delete your account in Settings → Delete account.

We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or if we discontinue the App. On termination, your license to use the App ends immediately. Sections 7 (your content, as to already-processed data), 8, 11, 12, 13 and 16 survive termination.


15. Changes to These Terms

We may update these Terms. When we do, we will change the “Last updated” date and post the revised Terms at https://podokorean.com/podospeak/terms-of-use. For material changes we will post the revised Terms at least 30 days before they take effect, and will use reasonable efforts to highlight the change — for example, in a notice shown in a new version of the App. Continued use of the App after the effective date constitutes acceptance. If you do not accept the revised Terms, stop using the App and cancel any subscription.


16. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Korea, without regard to conflict of law rules. Disputes will be subject to the exclusive jurisdiction of the courts of the Republic of Korea.

If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction whose mandatory consumer law grants you the right to bring proceedings in your place of residence and to the protection of your local consumer laws, nothing in this section deprives you of those rights.


17. General

  • Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and us regarding the App.
  • Severability: If any provision is held unenforceable, the remainder stays in effect.
  • No waiver: Our failure to enforce a provision is not a waiver of it.
  • Assignment: You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Apple-specific: If you obtained the App from the Apple App Store, you acknowledge that these Terms are between you and us, not Apple; that Apple has no obligation to provide maintenance or support for the App; that Apple is not responsible for any product warranty or product-liability, intellectual-property, or consumer-protection claims relating to the App; and that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
